Standards-making is especially important in the hi-tech sectors for achieving interoperability of new products and wide-scale and efficient adoption of new technologies. The more widely adopted a standard is, and the more it is "shared" among companies producing hi-tech goods and consumers using those goods, the more likely that standard will be successful. This aspect of standards is in tension with the proprietary and exclusive nature of intellectual property rights, and especially patents.
This tension is increasingly being manifested in significant legal developments -increased scrutiny by competition authorities of the intellectual property policies of standards-making bodies, new and convoluted legal disputes arising from standards patents, and continually developing case law on the obligations of participants in standards-making bodies. Recent developments of special note include the European Commission's cases against each of Rambus and Qualcomm, the recent DC Circuit Court of Appeal decision in the Rambus case, new theories of standards-related enforcement utilized by the FTC and increased standards-related patent litigation before the US ITC. Ongoing patent reform in Europe and the United States will likely also have an impact on the interface between standards and patents. Other developments, such as patent provisions in GPL version 3 are also of note.How will all these exciting developments play out?
