On 10th May 2016 the French Autorité de la Concurrence and the German Bundeskartellamt have published their joint study on competition law and the collection and use of data, with a specific focus on big data. The Big Data Study is the first comprehensive analyses of data related issues from a competition law perspective, providing guidance on how enforcers are likely to look at data related issues in the future.
Whilst data protection is traditionally outside the scope of competition law, the importance of data and competitive advantage it can give companies is becoming hard to ignore in the digital age, specifically in the context of mergers such as Facebook/WhatsApp, Microsoft/LinkedIn and Yahoo/Verizon.
